0. OBJECT

The following Terms and Conditions regulate the acquisition of the products offered on the website www.mirugastrofusion.com owned by MIRU SOCIEDAD INVERSIONES DIT I FET SL (hereinafter MIRU).

The acquisition of any of the products implies the full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Special Conditions that may be applicable when acquiring certain products.

These General Conditions may be modified without prior notice, therefore, it is advisable to read their contents carefully before proceeding with the purchase of any of the products offered.

All notifications and communications between users and MIRU shall be considered effective, for all purposes, when made by any of the means listed above.

3. PRODUCTS

The products offered, together with their main characteristics and price, are displayed on the screen.

MIRU reserves the right to decide, from time to time, the products and/or services offered to Customers. Thus, MIRU may, at any time, add new products and/or services to those currently offered. Likewise, MIRU reserves the right to withdraw or stop offering, at any time and without prior notice, any of the products offered.

All this without prejudice to the fact that the acquisition of any of the products can only be made through the subscription or registration of the USER, granting by MIRU to the interested party a user name and password, which will identify and enable him/her personally to have access to the products.

Once inside www.mirugastrofusion.com  and to access the contracting of the different products, the User must follow all the instructions indicated in the purchase process, which will imply the reading and acceptance of all the general and particular conditions set out in www.mirugastrofusion.com 

4. AVAILABILITY AND SUBSTITUTIONS.

PRODUCTS.

MIRU intends to guarantee the availability of all products that are advertised through www.mirugastrofusion.com.  However, in the event that any product ordered is not available or if the product is out of stock, the customer will be informed.

If the product is not available, and the consumer has been informed of this, MIRU may supply a product of similar characteristics without price increase, in which case, the consumer may accept or reject it by exercising his right of withdrawal and termination of the contract.

In case of unavailability of all or part of the order, and the rejection of the replacement products by the customer, the refund previously paid will be made Yes, by bank transfer

If MIRU is unjustifiably late in refunding the amounts paid, the consumer may claim double the amount owed.

5. PURCHASE AND/OR PROCUREMENT PROCESS.

To make any purchase in www.mirugastrofusion.com  it is necessary that the customer is of legal age.

2. To truthfully complete the mandatory fields of the registration form, in which personal data such as user name, e-mail, telephone number and address are requested.

3. Accept these Terms and Conditions of Use and Contracting.

5. Accept the Cookies Policy in its cookies necessary for operation.

The information necessary for the contracting; data that in any case will be truthful, accurate and complete about your identity and that the customer must expressly consent by accepting the general conditions.

In addition, if the customer registers in www.mirugastrofusion.com  through a data collection form in which MIRU is provided with the necessary information for the contracting; data that in any case will be truthful, accurate and complete about his identity and that the customer must expressly consent by accepting MIRU’s privacy policy.

BILLING.

Together with your order, you will receive the corresponding ticket along with instructions on how to request the invoice.

For this purpose, the customer consents to the invoice being sent to him in electronic format. The customer will receive it by e-mail, in PDF format. The customer may, at any time, revoke this consent by sending an e-mail to: proveedores@mirugastrofusion.com  

6. DELIVERY

SELF-DELIVERY MANAGED BY MIRU INVERSIONS DIT I FET S.L.

PRODUCTS

The order will be delivered to the address designated by the customer at the time of contracting according to the chosen method.

The scope of delivery includes the following areas: Castelldefels, Gavà, Viladecans.

7. PRICES, EXPENSES AND TAXES.

The prices of the products listed in www.mirugastrofusion.com  will be expressed in euros unless otherwise stated and will be guaranteed for the time of validity of the same, except for printing errors and whatever the destination of the order.

PRODUCTS

The final prices of all products (and, where applicable, the final prices per unit of measure, when required) together with their characteristics, offers, discounts, etc., are reflected in each of the items that appear in the www.mirugastrofusion.com  catalog.

  • VAT is included in the price of the products.
  • The VAT rate is 10% or 21% depending on the product.

The prices of the products may vary at any time. In this case, the price to be applied will be the one in force on the date the order is placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before it formalizes its acceptance.

8. METHODS OF PAYMENT.

These payment methods are available to you:

a. By credit or debit card

You can make the payment immediately through the SSL secure payment gateway of our Bank. If any refund or cancellation of the order is necessary, the amount will be refunded through the same payment card.

b. By bank transfer

By cash deposit or bank transfer. When making the transfer, the customer’s name and order number must be indicated.

c. Cash

Upon delivery of the order to your home.

9. RETURN AND CANCELLATION POLICY

According to the regulations, the consumer and user shall have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without stating the reason and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007, of November 16, which approves the text referred to in the General Law for the Defense of Consumers and Users.

This right of withdrawal does not apply to, among others:

  • Contracts for the supply of goods whose price is subject to fluctuations of financial market coefficients that the entrepreneur cannot control.
  • Contracts for the supply of products made to the specifications of the consumer and user or, clearly personalized, or which by their nature cannot be returned or are likely to deteriorate or expire rapidly, perishable products, fast food, etc.
  • Supply of sealed goods that cannot be returned for health or hygiene reasons.
  • Supply of goods that after delivery have been mixed with other goods.

10. PURCHASE OF ALCOHOLIC BEVERAGES

Users placing an order involving the purchase and/or delivery of alcoholic beverages through the platform must be of legal age, having reached the age of 18. By placing an order involving alcoholic beverages, the User confirms that he/she is at least 18 years of age. MIRU reserves the right to refuse to allow the purchase order and/or delivery of alcohol to any person who cannot prove to be at least 18 years of age.

11. ALLERGENS

The User is aware and accepts that all products sold by MIRU through the website may contain traces of allergens and, therefore, assumes full responsibility in this regard. Notwithstanding the above, MIRU has, in compliance with the regulations, the corresponding allergen information book available to the User. The User is in any case responsible for consulting the contents of this before placing the order.

12. DATA PROTECTION

At MIRU we process the information provided by the interested parties in order to carry out the administrative, accounting and fiscal management of the services requested, as well as to send promotional communications about our products and services. If you do not provide your personal data, we will not be able to fulfill the purposes described.

The data will be kept as long as the interested party does not request its deletion, and if necessary, for the years required to comply with legal obligations.

The data will be communicated to other entities or persons directly linked to the responsible, for the purpose of processing reservations and payments web customers, as well as for the loyalty plan or promotion for customers.

13. WARRANTY

Excluded from warranty are consumable products, deficiencies caused by improper use or manipulation, connection to the mains other than that indicated, incorrect installation or defects resulting from any external cause.

To file any complaint or claim with MIRU, the customer should contact the customer service department through the e-mail address proveedores@mirugastrofusion.com.

According to the EU Consumer Online Dispute Resolution and in accordance with Art. 14.1 of Regulation (EU) 524/2013, please be informed that the European Commission provides all consumers with an online dispute resolution platform which is available at the following link: http://ec.europa.eu/consumers/odr/  

15. APPLICABLE LAW

The present conditions shall be governed by the Spanish legislation in force.

The language used will be Spanish.
